MONITORING CHANGES IN LEGISLATION FOR THE PERIOD FROM 05/08/2024 TO 06/07/2024

1. New in legislation


- On attracting private investment in small technology companies
Order of the Ministry of Economic Development of the Russian Federation dated April 27, 2024 No. 263 “On the organization of work to attract private investment in small technology companies”

Indicators for creating conditions for attracting private investment in small technology companies have been determined. In 2024 - no less than 70 million rubles, in 2025 - no less than 105 million rubles. and in 2026 - at least 126 million rubles.

A procedure has been established for monitoring attracted private investments in small technology companies.

- The procedure for guarantee support for exports has changed
Decree of the Government of the Russian Federation of May 23, 2024 No. 662 “On amendments to Decree of the Government of the Russian Federation of November 1, 2008 No. 803” (the document has not entered into force)

It was decided to provide state guarantees to support exports in 2024. At the same time, ROSEXIMBANK exporters can receive state guarantees for loans they attract only in Russian currency. State guarantees can be provided to ensure the fulfillment of obligations of any Russian banks (previously - only ROSEXIMBANK). The validity period of state guarantees has been clarified.

The procedure for monitoring the targeted use of credit funds raised under government guarantees has been adjusted.

- The government has regulated the issues of forming fees for connecting power receiving devices with a capacity of over 150 kW to power grids
Decree of the Government of the Russian Federation of May 6, 2024 No. 594 "On amendments to certain acts of the Government of the Russian Federation on the technological connection of power receiving devices of electrical energy consumers to electrical networks"

In order to improve approaches to determining the amount of payment for connecting power receiving devices with a maximum power of over 150 kW to power grids, the Government has adjusted:

rules for technological connection to power grids of power receiving devices of electricity consumers, electricity production facilities, as well as power grid facilities owned by grid organizations and other persons;
fundamentals of pricing in the field of regulated prices (tariffs) in the electric power industry.
Certain provisions of government acts have been declared invalid. The resolution comes into force on July 1, 2024.

- Development, arrangement and material and technical equipment of the SEZ: plan forms have been approved
Order of the Ministry of Economic Development of the Russian Federation dated April 19, 2024 N 239 “On approval of the approximate form of a long-term plan for the development of a special economic zone and the form of a plan for the development and material and technical equipment of a special economic zone and the territory adjacent to the special economic zone.” Registered on May 24, 2024. Registration No. 78269. The Ministry of Economic Development approved the forms:

long-term plan for the development of a special economic zone (SEZ);
plan for the arrangement and material and technical equipment of the SEZ zone and the adjacent territory.
- Companies from priority sectors of the economy will receive support as part of the program to increase labor mobility
Decree of the Government of the Russian Federation dated May 27, 2024 No. 685 “On amendments to Decree of the Government of the Russian Federation dated March 13, 2021 N 362”

The SFR provides subsidies to businesses for employing certain categories of citizens. Now companies from priority sectors of the economy will also be able to participate in the hiring subsidy program if they attract specialists from other regions or municipalities.

To receive a subsidy, such enterprises will have to pay wages no lower than the regional average and implement a large project with an investment volume of over 3 billion rubles. At the same time, the volume of production of products or provision of services within the framework of the implementation of this project in the next 3 years should amount to more than 5% of the total gross volume of production of this type of product or service in the region and at least 100 employees should be involved in its implementation.

In addition, branches and (or) representative offices of Russian organizations located in new regions will receive support.

- The Territorial Development Fund will monitor the implementation of regional infrastructure projects
Decree of the Government of the Russian Federation of May 30, 2024 N 721 “On amendments to certain acts of the Government of the Russian Federation” The Territorial Development Fund promotes the modernization of regional infrastructure, including as part of monitoring the implementation of infrastructure projects and activities financed through budget loans or temporarily free funds of the single account of the federal budget approved

Government Commission for Regional Development.

- It has been determined which objects can be placed on recreational lands
Order of the Government of the Russian Federation dated June 1, 2024 No. 1372-r On approval of the list of facilities intended for recreational activities on recreational lands

The government has approved a list of facilities for carrying out recreational activities on recreational lands.

- The procedure for arranging ASEZ has been updated
Order of the Ministry of Finance of Russia dated May 29, 2024 No. 75n “On establishing requirements for the development and equipment of a priority development territory in which the customs procedure of a free customs zone is applied” (the document has not entered into force). Registered on May 31, 2024. Registration No. 78410.

New requirements have been established for the development and equipment of priority development areas where the free customs zone procedure is applied.

The order comes into force 30 days after official publication.

- The Ministry of Economic Development will update the regulations on the provision of lease of state and municipal lands in the SEZ
Draft Order of the Ministry of Economic Development of the Russian Federation "On approval of the Administrative Regulations of the Ministry of Economic Development of the Russian Federation for the provision of public services "Rental provision of land plots located within the boundaries of a special economic zone and in state or municipal ownership" (prepared by the Ministry of Economic Development of Russia on May 28, 2024)

A new regulation of the Ministry of Economic Development has been developed for the provision of land plots located within the boundaries of the SEZ and in state or municipal ownership for lease.

There are several options for providing public services. Information on the procedure for its provision will be posted on the Unified Portal. The maximum period for submission is 20 working days from the date of registration of the application and necessary documents. Results can be obtained by mail or from the authorities. The service will not be provided at the MFC.

2. Legislative initiatives


- Concession and public-private partnership mechanisms will be extended to the field of space activities
Dossier on draft federal law No. 578594-8 “On amendments to certain legislative acts of the Russian Federation” (on public-private partnership in the field of space activities) (introduced on March 19, 2024 by senators of the Russian Federation A.V. Kutapov, M.K.- G. Hapsirokov)

On May 28, 2024, the State Duma adopted in the first reading a bill according to which real estate related to space infrastructure and technologically related space objects will be able to become objects of concession agreements and public-private partnership agreements.

The Roscosmos State Corporation will be given the authority to conclude these agreements on behalf of the Russian Federation, as well as the authority of a grantor, a public partner in such agreements, subject to a Government decision to conclude an agreement. This will make it possible to attract investment in the development of the Russian space industry and increase the share of participation of Russian private companies in the global space market. In addition, it will be possible to create for the Russian Federation a full-fledged orbital constellation of spacecraft capable, among other things, of solving problems of operational monitoring of the Arctic zone.

- Russia ratifies the CIS Free Trade and Investment Agreement
Dossier on the draft federal law No. 595156-8 “On the ratification of the Agreement on free trade in services, establishment, activities and investments” (introduced on 04/06/2024 by the Government of the Russian Federation)

On May 28, 2024, the State Duma adopted the Law on the ratification of the Agreement on Free Trade in Services, Establishment, Activities and Investments.

The agreement was signed by Armenia, Belarus, Kazakhstan, Kyrgyzstan, Russia, Tajikistan and Uzbekistan. It will ensure the sustainable development of the CIS free trade zone in services and goods, taking into account their inextricable connection and favorable conditions for the growth of the economies of states.

In particular, in accordance with the obligations assumed by Uzbekistan, Russian service providers are guaranteed access to such sectors as business, communications, construction and related engineering services, educational, environmental, financial, health, cultural, sports, transport services, as well as services related to tourism and travel.

Tajikistan has additionally accepted obligations to provide services by payment system operators, as well as to conduct notarial activities.

In addition, Uzbekistan and Tajikistan accept obligations regarding market access and national treatment with respect to the establishment of companies, branches and representative offices in sectors of the economy not related to services (industry, agriculture). In these sectors, states guarantee Russian investors market access conditions no worse than those provided for by their legislation in force on the date of signing the agreement.

The agreement does not affect relations between EAEU states that already apply liberal terms of trade and investment.

- The EAEU will trade freely with Iran
Dossier on draft federal law No. 611322-8 “On the ratification of the Free Trade Agreement between the Eurasian Economic Union and its member states, on the one hand, and the Islamic Republic of Iran, on the other hand” (introduced on April 24, 2024 by the Government of the Russian Federation)

On May 28, 2024, the State Duma adopted a law on ratification of the Free Trade Agreement between the EAEU and Iran.

The agreement forms the basic rules of trade between the EAEU and Iran as close as possible to the rules of the WTO, including such as most favored nation treatment and national treatment, the use of protective measures and customs administration, refusal to use quantitative bans and restrictions on the import of goods . It also establishes obligations to ensure a 180-day transition period between the publication and entry into force of technical regulations. A preferential trade regime has been established for about 87% of the product range of foreign economic activity.

The agreement was signed in St. Petersburg on December 25, 2023. Its implementation will contribute to the further development of cooperation with Iran in the trade and economic sphere.
